Are Mushrooms Legal In Oklahoma

Mushrooms are a large group of fungi that find several uses, including culinary or medicinal. However, when concerned about the legality of “mushrooms”, the reference is generally towards “magic mushrooms”. These mushrooms contain a chemical substance known as psilocybin, which turns into psilocin when ingested.

To simplify things, these mushrooms are psychedelic drugs, also known as classic hallucinogens.

Their use has been known for a long time – and they’ve been illegal for a long time. 

The possession of psilocybin is illegal in Oklahoma. Its possession is a misdemeanor. However, growing or distributing psilocybin (through magic mushrooms) can invite much harsher penalties. 

To put it simply, the possession, growth, distribution, etc. of magic mushrooms is illegal in Oklahoma. 

But attitudes towards some psychedelics and controlled substances in general are slowly changing. Some studies and medical research also suggests that magic mushrooms might have medical uses or benefits. 

As a result, many states in the USA have changed their legal approach to magic mushrooms, while many others are considering such changes. 

As things currently stand, Oklahoma isn’t in either of those categories. There have been attempts to change the legal status of magic mushrooms in Oklahoma. However, the substance continues to be illegal, and has not been decriminalized or considered for medical use. 

Measures to change the legal status of magic mushrooms have been attempted in the Oklahoma legislature, but were not attempted. In 2022, HB 3414 by Rep. Daniel Pea attempted to decriminalize possession of psilocybin and considered allowing clinical trials and research into the substance and its uses. 

While the measure initially got some traction, eventually it failed to clear the legislature. Another bill, HB 3174 also attempted to look at clinical uses of psilocybin, but did not pass the legislature.

While there is some hope that the legal status of magic mushrooms will change in the future, it continues to be illegal at this moment.
